Bir Zikir uygulamasini ("Uygulama") indirerek, yukleyerek veya kullanarak, bu Kullanim Kosullari'ni ("Kosullar") okudugunuzu, anladiginizi ve bunlara bagli olmayi kabul ettiginizi beyan edersiniz. Bu Kosullar, sizinle ClearByte Dev ("Gelistirici", "biz", "bize", "bizim") arasinda yasal baglayici bir sozlesme olusturur.
Bu Kosullar'i kabul etmiyorsaniz, Uygulama'yi kullanmayiniz ve cihazinizdan kaldiriniz.
Uygulamayi kullanmaya devam etmeniz, yururlukteki Kosullar'in en son surumunu kabul ettiginiz anlamina gelir.
2. Hizmet Tanimi
Bir Zikir, iOS ve Android platformlari icin gelistirilmis bir Islami zikir sayaci uygulamasidir. Uygulama asagidaki hizmetleri sunmaktadir:
Dijital zikir (tesbih) sayaci
Gunluk zikir takibi ve istatistikleri
Dua ve hadis koleksiyonu
Gunluk hatirlatici bildirimleri
Hadis bildirimleri
Kisisel ibadet duzenleme araclari
Uygulama ucretsiz olarak sunulmakta olup, reklam destekli bir model ile isletilmektedir.
3. Kullanici Sorumluluklar
Uygulamayi kullanarak asagidaki sorumlulukları kabul edersiniz:
3.1 Saygin Kullanim
Uygulama, Islami icerik barindirmaktadir. Uygulamayi ve icerigini saygiyla kullanmayi, dini iceriklerin kutsalligina uygun davranmayi kabul edersiniz.
3.2 Yasaklanan Eylemler
Asagidaki eylemleri gerceklestirmemeyi kabul edersiniz:
Uygulamayi tersine muhendislik (reverse engineering), kaynak kodunu cozumleme (decompile) veya bozma (disassemble) islemine tabi tutmak.
Uygulamayi degistirmek, uyarlamak veya turev calismalar olusturmak.
Uygulamayi yasa disi amaclarla veya yururlukteki herhangi bir yasayi ihlal edecek sekilde kullanmak.
Uygulamanin guvenlik onlemlerini atlatmaya veya devre disi birakmaya calismak.
Uygulamanin sunucularina veya altyapisina asiri yuklenme olusturacak sekilde otomatik erisim saglamak.
Uygulamayi veya icerigini izinsiz ticari amaclarla kullanmak.
3.3 Hesap Gerekliligi
Uygulama, kullanici hesabi olusturulmasini gerektirmez. Hicbir kisisel bilgi (isim, e-posta, telefon numarasi vb.) talep edilmez.
4. Fikri Mulkiyet Haklari
Uygulama ve icerigi uzerindeki tum fikri mulkiyet haklari ClearByte Dev'e aittir. Bu haklar sunlari kapsar ancak bunlarla sinirli degildir:
Uygulama tasarimi, kullanici arayuzu ve kullanici deneyimi
Kaynak kodu ve yazilim mimarisi
Grafikler, ikonlar, logolar ve gorseller
Uygulama adi "Bir Zikir" ve iliskili marka unsurlari
Ozgun metin icerikleri ve derlemeler
Uygulamanin herhangi bir bolumunu onceden yazili izin almadan cogaltmak, dagitmak, lisanslamak, satmak veya herhangi bir ticari amacla kullanmak kesinlikle yasaktir.
Not: Kuran-i Kerim ayetleri, hadis-i serifler ve geleneksel dua metinleri kamuya ait dini iceriklerdir ve telif hakki iddiasi disindadir. Ancak bu iceriklerin uygulama icindeki duzenlenmesi, sunumu ve derlemesi ClearByte Dev'in fikri mulkiyetini olusturur.
5. Islami Icerik Sorumluluk Reddi
Uygulama icinde sunulan Islami iceriklerle ilgili asagidaki hususlari onemle belirtiriz:
Uygulamada yer alan hadis-i serifler, dualar ve dini icerikler yalnizca bilgilendirme amaciyla sunulmaktadir.
Icerikler, dini konularda yetkili alimlere ve kaynaklara danismanin yerini tutmaz.
Kullanicilar, uygulamada yer alan dini bilgileri nitelikli Islami alimler ve guvenilir kaynaklar ile dogrulamalidir.
Uygulama, kapsamli bir Islami egitimin veya ilahiyat oğreniminin yerini almaz.
ClearByte Dev, iceriklerin belirli bir mezhep veya yoruma gore eksiksiz veya hatasiz oldugunu garanti etmez.
Dini iceriklerle ilgili herhangi bir hata veya eksiklik tespit etmeniz halinde, lutfen dijitalartdesigner@gmail.com adresinden bizimle iletisime gecin. Geri bildirimleriniz icerigi iyilestirmemize yardimci olur.
6. Reklamlar
Uygulama, Google AdMob araciligiyla reklam icermektedir. Reklam gosterimi, uygulamanin ucretsiz olarak sunulabilmesi icin gereklidir.
Reklam hizmetleri kapsaminda toplanan veriler, Gizlilik Politikamiz'da detayli olarak aciklanmaktadir. Google AdMob, kisisellesitirilmis veya genel reklam sunmak amaciyla kullanim verilerini isleyebilir.
iOS kullancilari, Apple'in Uygulama Izleme Seffafligi (ATT) cercevesi kapsaminda reklam izleme tercihlerini yonetebilir.
7. Garanti Reddi
Uygulama, "OLDUGU GIBI" ve "MEVCUT OLDUGU SEKLIYLE" sunulmaktadir. ClearByte Dev, acik veya zimni hicbir garanti vermemektedir. Bu kapsamda, ancak bunlarla sinirli olmamak uzere:
Uygulamanin kesintisiz, hatasiz veya guvenli bir sekilde calisacagina dair garanti verilmez.
Uygulamanin belirli bir amaca uygunlugu veya ticari elverisliligine dair garanti verilmez.
Uygulamadaki iceriklerin dogrulugu, eksiksizligi veya guncelligi garanti edilmez.
Uygulamanin ucuncu taraf cihaz, isletim sistemi veya yazilimlarla uyumlulugu garanti edilmez.
Uygulamanin kullanimindan kaynaklanan tum risk ve sorumluluk tamamen kullaniciya aittir.
8. Sorumluluk Sinirlamasi
Yururlukteki yasalarin izin verdigi azami olcude, ClearByte Dev ve bagili kisilar, yoneticiler, calisanlar veya temsilcileri asagidaki durumlardan dolayi hicbir sekilde sorumlu tutulamaz:
Uygulamanin kullanimindan veya kullanilamamasindan kaynaklanan dogrudan, dolayli, arizi, ozel, cezai veya sonuc olarak ortaya cikan zararlar.
Veri kaybi, kar kaybi, is kaybi veya itibar kaybi.
Ucuncu taraf hizmetlerinin (Google AdMob dahil) eylem veya ihmalleri.
Uygulamanin herhangi bir nedenle kullanilamaz hale gelmesi.
ClearByte Dev'in toplam sorumlulugu, her durumda, zararın ortaya ciktigi tarihten onceki 12 (on iki) ay icinde kullanici tarafindan Uygulama icin odenmis tutarla (varsa) sinirlidir.
9. Tazminat
Uygulamayi kullanmanizdan, bu Kosullar'i ihlal etmenizden veya ucuncu taraflarin haklarini ihlal etmenizden kaynaklanan veya bunlarla baglantili her turlu talep, dava, zarar, yukumluluk, maliyet ve masrafa (makul avukatlik ucretleri dahil) karsi ClearByte Dev'i, yoneticilerini, calisanlarini ve temsilcilerini tazmin etmeyi, savunmayi ve zararsiz tutmayi kabul edersiniz.
10. Fesih
ClearByte Dev, herhangi bir zamanda, herhangi bir nedenle veya nedensiz olarak, onceden bildirimde bulunmaksizin Uygulamaya erisinizin tamamini veya bir bolumunu askiya alma veya sonlandirma hakkini sakli tutar.
Bu Kosullar'in herhangi bir hukumunu ihlal etmeniz halinde, Uygulamayi kullanma hakkiniz derhal ve otomatik olarak sona erer.
Fesih uzerine:
Uygulamayi kullanmaya derhal son vermeniz gerekmektedir.
Yerel cihazinizda saklanan veriler etkilenmez.
Bu Kosullar'in niteligine gore fesihten sonra da yururlukte kalmasi gereken hukumleri (Fikri Mulkiyet, Sorumluluk Sinirlamasi, Tazminat vb.) gecerliligi devam eder.
11. Uygulanacak Hukuk
Bu Kosullar, Turkiye Cumhuriyeti kanunlarina tabi olup, bu kanunlara gore yorumlanacaktir (kanunlar ihtilafi hukumleri haric).
Bu Kosullar'dan veya Uygulama kullanimindan kaynaklanan herhangi bir uyusmazlik, oncelikle taraflar arasinda iyi niyetli muzakereler yoluyla cozumlenmeye calisilacaktir. Uzlasma saglanamadigi takdirde, uyusmazlik Turkiye Cumhuriyeti mahkemeleri tarafindan cozume kavusturulacaktir.
ClearByte Dev, bu Kullanim Kosullari'ni herhangi bir zamanda degistirme veya guncelleme hakkini sakli tutar. Degisiklikler yapildiginda:
Guncellenmis Kosullar bu sayfada yayinlanacaktir.
"Yururluk Tarihi" guncellenecektir.
Onemli degisikliklerde uygulama ici bildirim yoluyla kullanicilar bilgilendirilmeye calisilacaktir.
Degisikliklerin yayinlanmasindan sonra Uygulamayi kullanmaya devam etmeniz, guncellenmis Kosullar'i kabul ettiginiz anlamina gelir. Guncellenmis Kosullar'i kabul etmiyorsaniz, Uygulamayi kullanmaya son vermeniz gerekmektedir.
13. Bolunebilirlik
Bu Kosullar'in herhangi bir hukmu, yetkili bir mahkeme tarafindan gecersiz, yasa disi veya uygulanamaz olarak degerlendirilirse, soz konusu hukmun gecersizligi diger hukumlerin gecerliligi ve uygulanabilirligini etkilemeyecektir. Gecersiz veya uygulanamaz hukum, taraflarin niyetine en yakin yasal olarak gecerli bir hukumle degistirilmis sayilacaktir.

Bu Kullanim Kosullari hakkinda sorulariniz veya endiseleriniz icin bizimle iletisime gecebilirsiniz:
By downloading, installing, or using the Bir Zikir application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and ClearByte Dev ("Developer", "we", "us", "our").
If you do not agree to these Terms, do not use the App and remove it from your device.
Your continued use of the App constitutes acceptance of the most current version of these Terms.
2. Description of Service
Bir Zikir is an Islamic dhikr (remembrance of God) counter application developed for iOS and Android platforms. The App provides the following services:
Digital dhikr (tasbih) counter
Daily dhikr tracking and statistics
Dua (supplication) and hadith collection
Daily reminder notifications
Hadith notifications
Personal worship organization tools
The App is provided free of charge and operates on an advertisement-supported model.
3. User Responsibilities
By using the App, you agree to the following responsibilities:
3.1 Respectful Use
The App contains Islamic content. You agree to use the App and its content with respect and to act in accordance with the sanctity of the religious content.
3.2 Prohibited Actions
You agree not to engage in the following actions:
Reverse engineer, decompile, or disassemble the App.
Modify, adapt, or create derivative works based on the App.
Use the App for unlawful purposes or in violation of any applicable law.
Attempt to bypass or disable the App's security measures.
Access the App's servers or infrastructure through automated means in a way that creates excessive load.
Use the App or its content for unauthorized commercial purposes.
3.3 Account Requirement
The App does not require the creation of a user account. No personal information (name, email, phone number, etc.) is requested.
4. Intellectual Property
All intellectual property rights in and to the App and its content belong to ClearByte Dev. These rights include, but are not limited to:
App design, user interface, and user experience
Source code and software architecture
Graphics, icons, logos, and visual elements
The app name "Bir Zikir" and associated branding elements
Original text content and compilations
Reproduction, distribution, licensing, sale, or commercial use of any part of the App without prior written permission is strictly prohibited.
Note: Quranic verses, hadiths, and traditional dua texts are public-domain religious content and are excluded from copyright claims. However, the arrangement, presentation, and compilation of such content within the App constitute the intellectual property of ClearByte Dev.
5. Islamic Content Disclaimer
We wish to emphasize the following points regarding the Islamic content presented within the App:
Hadiths, duas, and religious content within the App are provided for informational purposes only.
The content is not a substitute for consulting qualified scholars and authoritative sources on religious matters.
Users should verify the religious information in the App with qualified Islamic scholars and trusted sources.
The App is not a substitute for comprehensive Islamic education or theological study.
ClearByte Dev does not guarantee that the content is complete or error-free according to any particular school of thought (madhhab) or interpretation.

6. Advertisements
The App contains advertisements served through Google AdMob. Advertisement display is necessary for the App to be offered free of charge.
Data collected in connection with advertising services is described in detail in our Privacy Policy. Google AdMob may process usage data for the purpose of serving personalized or general advertisements.
iOS users can manage their ad tracking preferences under Apple's App Tracking Transparency (ATT) framework.
7. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. ClearByte Dev makes no express or implied warranties, including but not limited to:
No guarantee that the App will operate uninterrupted, error-free, or securely.
No guarantee of fitness for a particular purpose or merchantability.
No guarantee of the accuracy, completeness, or currency of the content within the App.
No guarantee of compatibility with third-party devices, operating systems, or software.
All risk and responsibility arising from the use of the App rests entirely with the user.
8. Limitation of Liability
To the maximum extent permitted by applicable law, ClearByte Dev and its affiliates, directors, employees, or agents shall not be liable for any of the following:
Direct, indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the App.
Loss of data, loss of profits, loss of business, or loss of reputation.
Acts or omissions of third-party services (including Google AdMob).
The App becoming unavailable for any reason.
ClearByte Dev's total liability shall, in all cases, be limited to the amount paid by the user for the App (if any) during the twelve (12) months preceding the date on which the damage arose.
9. Indemnification
You agree to indemnify, defend, and hold harmless ClearByte Dev, its directors, employees, and agents from and against any and all claims, actions, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to your use of the App, your violation of these Terms, or your infringement of any third-party rights.
10. Termination
ClearByte Dev reserves the right to suspend or terminate all or part of your access to the App at any time, for any reason or without reason, without prior notice.
If you violate any provision of these Terms, your right to use the App shall immediately and automatically terminate.
Upon termination:
You must immediately cease using the App.
Data stored locally on your device will not be affected.
Provisions of these Terms that by their nature should survive termination (Intellectual Property, Limitation of Liability, Indemnification, etc.) shall continue in full force and effect.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, excluding its conflict of law provisions.
Any dispute arising from these Terms or the use of the App shall first be attempted to be resolved through good-faith negotiations between the parties. If a settlement cannot be reached, the dispute shall be resolved by the courts of the Republic of Turkey.
ClearByte Dev reserves the right to modify or update these Terms of Service at any time. When changes are made:
The updated Terms will be published on this page.
The "Effective Date" will be updated.
Users will be notified of significant changes via in-app notification where possible.
Your continued use of the App following the publication of changes constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you must discontinue use of the App.
13. Severability
If any provision of these Terms is found by a competent court to be invalid, illegal, or unenforceable, the invalidity of such provision shall not affect the validity and enforceability of the remaining provisions. The invalid or unenforceable provision shall be deemed replaced by a legally valid provision that most closely reflects the intent of the parties.
